Contract for Services

Unless otherwise outlined and understood, all photographs will be property of ASWalker Photography.  Any reproduction of digital images must have a tag to link the business or owner to the photographs.  (Example: photos posted on a personal Facebook page must mention “Shadia Walker” or “ASWalker Photography.”) Photographs are for personal use only and not allowed to be published anywhere besides social media.  Photographs may not be used for advertising purposes.

ASWalker Photography reserves the right to have photographs printed.  In order to reproduce images, contact must be given to the photographer and they must give permission to have photographs printed.  ASWalker Photography can have photographs printed for you.  Any photograph printed will cost the invoiced amount from ASWalker Photography. If client is unsatisfied with printed images, they may return them for a full refund.  Damaged products are not eligible for refund, nor is ASWalker Photography responsible.

It is understood that ASWalker Photography has sprung forth with the blessing of God and will not do anything that would cause blasphemy or distasteful production.  This includes, but is not limited to, hateful behavior or language, gang-related insignia, curse words, inappropriate attire, overtly sexual behavior, or the promotion of satanic religions.  Every photograph taken will be with the purpose to glorify God.  If the photographic purpose does not do that, ASWalker Photography reserves the right to withdraw services during the photo shoot.  Payment will be given in full, regardless, for time given at the hourly rate, and the session will end.  ASWalker Photography reserves the right to not edit photographs that are distasteful or pornographic in nature.

If the photographer cannot perform the agreed upon terms of the photo shoot due to illness, injury, or an act of God, they will return the amount of money paid or no money will be paid, without liability to ASWalker Photography.  The deposit amount will not be returned.  Instead, ASWalker Photography will reschedule the photoshoot at the next convenient date for herself and the client.  If client cancels photoshoot, ASWalker Photography will keep the deposit amount and remaining amount will not be requested.  In the case of a cancellation due to illness, weather conditions, injury, or an Act of God, ASWalker Photography will reschedule as best as possible with client on photographer’s schedule.  Mini shoots are not eligible for rescheduling, but deposit may count towards a different photoshoot or future mini session up to 60 days from original deposit paid date.

If the client wishes to do something that could put them in danger of, illness or injury, ASWalker Photography has the right to refuse services. ASWalker Photography will abide by all local, state, and federal laws and regulations.  The client will take full responsibility for all poses during the shoot.  If the client does not wish to do a pose during a shoot, they will request a different pose or refrain from performing it.  ASWalker Photography follows the philosophy of safety being more important than getting the photograph captured.

WAIVER AND INDEMNIFICATION

Client and its agents, family members, and assignee’s, if any, shall indemnity, will not hold the family members of ASWalker Photography at fault or liability for any and all claims to damages or injuries arising out of performance of photographic services. 

Deposits, Reservations, and Payment

Upon reviewing and signing this contract, the photographer will reserve the time requested for the client with deposit.  Deposit is necessary prior to reservation of time slot.  Without deposit, photographer is not responsible to schedule and hold appointment.  At the end of the photoshoot, the time and rate will be calculated for full amount due before photographs are returned via a gallery creation.  Example: if a family is requesting portraits, they will have to pay amount deposit amount before appointment is set and remaining amount after the photoshoot ends.  Payment can be given in cash or check to Shadia Walker.  Other payment methods available are as follows:  CashApp $AyatWalker, Venmo, @ShadiaWalker or Paypal. 

Editing Photographs

ASWalker Photography does not give permission to clients to edit photographs.  This includes, but is not limited to, filters, removing the watermark, posting photographs without credit, and giving digital copies to other photographers to edit.  ASWalker Photography also disallows other persons from keeping digital copies of wedding photographs taken except for bride and groom.  If a person requests to see digital copies, they may do so and purchase digital copies or print release from ASWalker Photography. 

Every photograph given to the client has been created at the scene and edited by the photographer with their specific artistic style.  If a client does not like the artistic style of ASWalker Photography, they can request a different editing style, or not have any further photographic services performed by them.  ASWalker Photography prefers clients to look at their portfolio prior to buying their services before they decide. Clients must decide after viewing portfolio if ASWalker Photography is a fit for their style, if ASWalker Photography is not a fit, client must not use ASWalker Photography services.  Client may cancel wedding prior to the date, without deposit amount, if they find ASWalker Photography’s portfolio to no longer suit them.

Thank you for your cooperation and review of this contract.  If you agree to the terms, please sign and date below.  This must be signed before ASWalker Photography can give photographic services.

This clause is specific to weddings only.  Upon agreement of ASWalker Photography being the wedding photographer, the client will pay a deposit amount to guarantee their reservation.  The deposit amount will be $200.00 and due as soon as the wedding needs to be reserved.  ASWalker Photography is not responsible for reservations being made unless the deposit is paid.  Payment plans are available upon request and with contract only.  If client refuses to honor contract, ASWalker Photography will keep deposit amount and may cancel their wedding date at any time.

30 days before wedding date, the client will pay the photographer the full amount owed.  If client refuses to pay full amount up to two weeks before wedding date, photographer can keep whatever client has paid up to that point and cancel their wedding date.  Upon the day of the wedding, client will pay any additional costs incurred to photographer, such as, but not limited to travel fees, tolls, parking, and other reasonable costs necessary to let the photographer perform their services.  Client will also ensure photographer has snacks and water available to them.  Client will also give photographer a 30 minute break every 4 hours and a 10 minute break every hour, this gives the photographer time to eat and drink as necessary to perform duties.  If client does not ensure photographer has food, water, and breaks available, photographer can leave wedding without paying back deposit or any other amount paid to them.  Photographer is not responsible to edit or return any digital images.

In the event a wedding guest, or client themself is disrespectful or rude to photographer, photographer can leave wedding without paying back any deposit or money already paid to them.  Photographer does not have to edit or return any digitals.  Clients must understand the best way to work on the best wedding photographs possible on their wedding day is with cooperation and dedication to each other.  AS Walker Photography believes in kindness and good will, let’s treat each other with the utmost respect.  

AS Walker Photography is the only contracted wedding photographer for your big day.  This means if a second shooter is required, AS Walker Photography will contract and deliver a second shooter on the day of the wedding.  Second shooters are not provided on rehearsals.  If another photographer is contracted on your wedding day, and AS Walker is not notified, she may leave the wedding at any point and retain payment as due, along with deposit.  

Upon signature of this contract and deposit, ASWalker Photography will guarantee and reserve the day of the wedding, the rehearsal, and reception time, if requested.  After the deposit, and for this reason, the retainer will be non-refundable.  Upon an act of God, illness, or injury, ASWalker Photography will move the reservation to the new wedding date as requested if her schedule allows it.  If she is unable to keep new wedding date, ASWalker Photography is not responsible for returning deposit amount but will return any amount paid over deposit.

The client will assist and promote the direction of the photographer during the wedding or designate a person to do so for them.  The client will give an itinerary to the photographer as well as a list of photographs the client would like to have made for them.  If the client fails to do this, ASWalker Photography and its photographers are not responsible for any photographs not taken.
